These Terms of Service ("Terms") govern your access to and use of the YunoTheMenu mobile application and the website at yunothemenu.com (collectively, the "Service"), operated by YunoTheMenu LLC ("YunoTheMenu," "we," "us," or "our").
1. The Service
YunoTheMenu is a mobile application that helps users filter restaurant menus by dietary preferences, discover restaurants, share reviews and photos, and connect with friends. Certain features require you to create an account and verify a phone number.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
2. Eligibility and Accounts
2.1 Age Requirement
You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have your parent's or legal guardian's permission.
2.2 Account Registration
To use most features of the Service, you must create an account by verifying a valid mobile phone number. You are responsible for:
- Providing accurate information
- Maintaining the security of your phone and any devices used to access the Service
- All activity that occurs under your account
You agree to notify us immediately of any unauthorized access to your account.
2.3 One Account Per Person
You may not create multiple accounts, create an account on behalf of someone else without authorization, or use the Service to impersonate another person.
3. Dietary Information Disclaimer
THIS SECTION IS IMPORTANT. PLEASE READ CAREFULLY.
YunoTheMenu provides dietary filtering and menu analysis as an informational tool to help users identify menu items that may align with their stated dietary preferences. This is not medical advice, nutritional advice, or allergen certification.
- Menu information may be incomplete, outdated, or incorrect. Restaurants change recipes, ingredients, and preparation methods without notice. The Service relies on menus provided by restaurants and AI-assisted analysis of those menus, which may contain errors.
- Cross-contamination is not detected by the Service. Even menu items flagged as compatible with your dietary preferences may be prepared in kitchens that also handle allergens or ingredients you need to avoid.
- If you have a severe food allergy, celiac disease, or any other serious dietary condition, you must confirm ingredients and preparation methods directly with restaurant staff before ordering. Do not rely solely on YunoTheMenu to make food safety decisions.
- YunoTheMenu is not responsible for adverse reactions, allergic responses, or any health consequences resulting from your use of the Service.
By using the Service, you acknowledge and accept these limitations and agree that you are solely responsible for your dietary choices.
4. User Content
4.1 Your Content
You may submit photos, reviews, ratings, comments, and other content to the Service ("User Content"). You retain ownership of your User Content.
4.2 License to Us
By submitting User Content, you grant YunoTheMenu a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, display, publish, and distribute your User Content in connection with operating, promoting, and improving the Service. This license continues even if you stop using the Service, for User Content that has been shared with others or is otherwise part of the Service's public record.
Public display of photos via Cover Shots. By default, photos you upload are visible only to your followers. However, photos that meet our quality and eligibility criteria may be selected — automatically or through community voting — as "Cover Shots" representing a menu item or category. Cover Shots are publicly visible within the Service, including to users who are not signed in. By uploading photos, you acknowledge that any photo you submit may be promoted to Cover Shot status and displayed publicly. You may remove your photos at any time to end this display.
4.3 Your Responsibilities
You are solely responsible for the User Content you submit. You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not violate any law, third-party rights, or these Terms
- Your User Content is accurate and not misleading
4.4 Removal and Automated Moderation
We reserve the right, but have no obligation, to remove User Content that we determine violates these Terms or is otherwise objectionable, without notice. Content moderation on the Service is performed through a combination of automated systems and user reports. Uploaded photos are automatically reviewed by a third-party AI service for safety and policy compliance, and content that fails this review or that receives multiple user reports may be removed or restricted automatically. You may appeal any removal or restriction by contacting us at the email address below, and we will review appeals in a reasonable time.
5. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Post content that is defamatory, obscene, harassing, threatening, hateful, or infringing
- Post content that sexualizes or endangers minors
- Impersonate any person or entity
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
- Interfere with or disrupt the Service, including by introducing malware, viruses, or excessive automated requests
- Scrape, crawl, or harvest data from the Service without our written permission
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use the Service to send spam, unsolicited messages, or advertising
- Upload photos of people without their consent
- Use the Service to stalk, harass, or harm others
Violation of these rules may result in suspension or termination of your account.
6. Intellectual Property
The Service, including its design, text, graphics, logos, icons, images, software, and underlying technology, is owned by YunoTheMenu LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited rights granted to you under these Terms, you may not copy, modify, distribute, sell, or create derivative works based on the Service.
"YunoTheMenu" and related logos are trademarks of YunoTheMenu LLC.
7. Third-Party Services
The Service may integrate with or link to third-party services (such as Apple, Google, Twilio, and restaurant information providers). We are not responsible for the content, practices, or policies of third-party services. Your use of third-party services is governed by their own terms and privacy policies.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that the Service will be uninterrupted, secure, error-free, or that any information (including menu data, restaurant information, or dietary analysis) will be accurate, complete, or current.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YUNOTHEMENU LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In any event, our total cumulative liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless YunoTheMenu LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any rights of another person or entity
11. Termination
You may stop using the Service and request account deletion at any time. We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including disclaimers, limitations of liability, indemnification, and governing law) will survive.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah, and you consent to the personal jurisdiction of those courts.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and YunoTheMenu regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms freely.
